Study’s Show Small Loan Modifications Failing

Interesting article today on DSNews.com. According to a study by Credit Suisse & Moody’s a lot of loan modifications are failing and borrowers are becoming deliquent within 8 months.

One third of all subprime loans modified in the third quarter of 2007 were delinquent again within 10 months, according to a Credit Suisse report. A study by Moody’s ratings agency showed similar results. Looking at subprime adjustable-rate mortgages (ARMs) modified in the first half of 2007, the agency found that by March 2008, only a third were still current or had been fully paid, and two-thirds had fallen back into default.

Last month, the HOPE NOW Alliance reported that its members had made 98,000 loan modifications in September alone – a monthly record for modification workouts. While the industry is pressing forward with trying to preserve homeowners’ American dreams by offering modifications instead of proceeding with foreclosure, these studies show that there are still challenges to lenders’ loss mitigation efforts.

Consumer groups argue that part of the re-default problem is lenders’ reluctance to make the sorts of changes that will really improve a homeowner’s chances, a report in Time magazine said. Many think of a loan modification as lowering interest rates or reducing the overall loan balance. However, one of the most widely used adjustments is to simply spread missed payments over the remaining life of the loan, which has the contrary effect of raising, instead of lowering, the homeowner’s monthly payment. According to the nonprofit Center for Responsible Lending (CRL), nearly half of the loan modifications reported by HOPE NOW have left homeowners with the same or higher monthly payments, Time reported.

Going back to that Credit Suisse study, researchers found that 44 percent of loans with increased monthly payments became at least 60 days delinquent within eight months. On the other hand, reducing interest rates or principal had a much better chance of working. According to data from Credit Suisse, only 15 percent of loans that had received an interest-rate reduction and 23 percent in which the principal balance had been reduced were more than 60 days delinquent after eight months.

With approximately 3.5 million U.S. homeowners currently behind on their mortgage payments, lenders face pressure from every side to find a workable solution to stave off foreclosure. Long-term modifications that bring mortgages into the range of “affordable” allow homeowners to stay in their homes, lenders and investors to recover more capital than they would see from a foreclosure in today’s market, and mean that fewer vacant, foreclosed properties hit the marketplace. Many would argue that’s a “win” on every side.

 

Why the Appraisal Is So Important In Short Sales

At some point in your short sale process the bank will want to know what the property is worth. They do this by ordering an appraisal, Broker Price Opinion (BPO) or both.

Whether the bank sends out an appraiser or a broker to do a BPO the result of their evaluation will make or break your short sales success. Most banks won’t consider selling the property for less than 85% of the appraised value, some will ask for 90% or above. With that said, it’s critical that the appraisal or BPO comes in at a price that a buyer is willing to pay.

There are a few things that you can do to make sure the appraiser does not give an inflated opinion of value. First meet the appraiser at the property, and walk through the property. This gives you an opportunity to talk to the appraiser and point out any defects of the property. It is also a good idea to bring a few comparable properties they can use for their appraisal. This will save them work and will make sure that they are using realistic comparable properties.

You should also provide the appraiser with a copy of the purchase agreement. Appraisers are used to working backwards. Most appraisals are done for purchases or refinancing, in both of these instances the appraiser will have a target number, they then try and prove that the property is worth that amount. This is why most appraisals come in at the purchase price or very close to it, even if the property is worth more. With that said, the appraiser is more likely to value the property close to the short sale offer if they are aware of the offer.

The most important thing is communicate with whoever is doing the evaluation. Your short sale is almost sure to fail if the bank gets an appraisal much higher than your offer.

Does 100% Financing Still Exist?

With the changes in the credit market and the new FHA guidelines 100% financing is almost impossible to find.  I say almost because there are a few programs still available.  One of them is the U.S.D.A. Rural Development Program.  The U.S.D.A. Rural Development Program is a government backed loan that allows homebuyers in qualified areas to get up to 102% financing.  Some of the other benefits include:

·         No mortgage Insurance

·         No maximum purchase limit

·         Home repairs can be included in the loan

·         No minimum credit score

·         Flexible income limits

Like all government programs there are restrictions, and the major restriction on this program is the areas that are eligible. 

Some of the areas in Shasta County that qualify are Bella Vista, Palo Cedro, Anderson, Shasta Lake, Cottonwood, Shingletown and parts of Redding.

Halloween Fun For This Weekend

pumpkinpatch.jpgI have not taken the kids to get pumpkins yet this year, so it looks like that’s what I will be doing Saturday.  We usually go to one of the pumpkin patches but I am not sure which one we will go to this year.   I like the Nash Ranch mainly because it is less of a drive but Hawes Farm is bigger and has more things for the kids to do.  Which one do you prefer?  Take our Poll.

Lease Option 101

https://www.parsonsrealty.com/parsons_realty/josh_blog.JPGIn today’s tough credit market investors and homebuyers are having a hard time getting reasonable financing to put deals together.  Therefore we have been focusing more on creative financing and one of the techniques we like to use is a Lease Purchase Contract.  The term “lease purchase” is known by several other names, such as “rent-to-own,” “lease option,” and “lease with the option to buy.”  These are all basically the same thing.
 
How Does It Work?

The lease purchase contract combines a lease agreement with an option-to-purchase-contract.  The tenant/buyer pays to the landlord/seller a nonrefundable deposit that is applied to the purchase price of the home (not the down payment.)  The tenant/buyer then pays to the landlord/seller rent to compensate them for the use of the property.  Rent payments are typically made on a monthly basis with a portion of that payment applied to the purchase price of the home.

During the term of the lease, but before the option expires, the tenant/buyer has exclusive right to lease and buy the home under the terms to which both parties have previously agreed.  The seller cannot change their mind, raise the sales price, or further encumber the property or sell to a different party while the tenant/buyer owns the exclusive right to purchase the property. 

What Paperwork Is Needed?

There are three parts to the lease purchase contract, the lease agreement, option to buy, and the purchase contract.  The lease agreement spells out the terms of the lease.  The option agreement will state the option price which is non-refundable and is applied towards the purchase price.  It also contains the option term which is the specific date the option expires and the method of exercising the option.  If a portion of the monthly rent is being applied to the purchase price of the home it should be stated in this contract as well.  The Purchase Contract covers the escrow instructions and timelines of contingencies.
